Atos Medical wins appeal in patent litigation with Helix Medical and Servona

Atos Medical AB announces results from German appeal patent litigation after the final hearing in July 2010. The “Oberlandesgericht” Karlsruhe has in a verdict of September 22, 2010, ruled in favor of Atos Medical and one of its patents regarding Provox^® HME Heat and Moisture Exchangers EP 1 077 658 B1. The Helix product Blom-Singer^® HME – Filterkassette, also named Easy-Touch^® is in the appeal verdict ruled to infringe on Atos Medical patent and shall immediately be withdrawn from the German market. Helix and Servona are further also liable to pay damages to Atos Medical.

The court has not allowed the legal appeal to the Federal Supreme Court. The decision by the court not to allow the legal appeal can, however, still be challenged by Helix Medical and Servona, so that the decision is not yet final.
