Atos Medical asserts patent and wins a preliminary injunction against Servona GmbH

Atos Medical AB announces that the District Court Munich I has granted a preliminary injunction against Servona GmbH. Due to this preliminary injunction, Servona must cease to offer, put on the market, or to for these purposes import or possess "Servox HME Moduls" in the Federal Republic of Germany.

In its decision of August 17, 2011, the court rendered in favor of Atos Medical without hearing, and established an infringement of the German portion of the European Patent EP 0 735 844. This patent is one of Atos Medical's patents regarding Provox^® HME Heat and Moisture Exchangers.

After the decision has entered into force, Servona is obliged to stop immediately all acts of patent infringement in Germany. The preliminary injunction is an interim decision which can be challenged by Servona by several legal remedies.
